Our deputy chair talks directors’ and officers’ liability on eNCA

CN&CO deputy chair, Lee Astfalck, appeared on eNCA’s morning news today in his capacity as litigation insurance director at Norton Rose Fulbright. The topic under discussion with veteran broadcast journalist and prime time anchor Dan Moyane was the responsibilities and potential liabilities that come with being a director or senior manager at any company in South Africa.

“Something that a lot of people don’t realise is that when you are appointed as a director, you can be help personally liable for breach of duty,” said Lee. “Make sure you have directors and officers insurance in place to cover any liability that may arise.”

Although Lee gave a really good interview, he says wouldn’t want to do it every day.

“It is very nerve-wracking!” he says. “You make it look so easy to deal with the press. But when you’re up there, it’s a completely different ball game.”
